O'FALLON, MISSOURI, MAN INDICTED ON ADDITIONAL INTERNET CHILD ENTICEMENT OFFENSESRandy G. Massey, United States Attorney for the Southern District of Illinois, announced today that on October 16, 2007, a Federal Grand Jury sitting in East St. Louis, Illinois, returned a 16 count superseding indictment against BRIAN MICHAEL GREEN, age 34, of O'Fallon, Missouri. Green was originally indicted on August 22, 2006, in a one count indictment for traveling in interstate commerce from the State of Missouri to St. Clair County, Illinois, on July 22, 2006, for the purpose of engaging in illicit sexual conduct with a minor. The superseding indictment charges him in 15 dditional counts of attempting to persuade, induce and entice a minor child, through the internet, to engage in sexual activity between July 15 and July 22, 2006. In the first 6 counts, the indictment alleges the minor was 14 years of age and in Counts 7 through 15, it alleges the minor was 15. In Count 16, GREEN, who is alleged to be 19 years older than the minor, is charged with traveling from Missouri to Illinois for purposes of engaging in illicit sexual conduct with the minor. If convicted, each of counts 1 through 15 carry a possible penaltyof life imprisonment and a minimum mandatory 10 year sentence, a $250,000 fine and a term of supervised release of 5 years. If convicted on Count 16, the defendant faces a possible penalty of 30 years imprisonment, a fine of up to $250,000, and a term of supervised release of 5 years. An indictment is a formal charge against a defendant. Under the law, a defendant is presumed to be innocent of a charge until proved guilty beyond a reasonable doubt to the satisfaction of a jury. A final pretrial is set for November 5, 2007, at 10 a.m. in United States District Court for the Southern District of Illinois, at East St. Louis. The jury trial is set for November 27, 2007, in East St. Louis. The investigation was conducted by the O'Fallon, Illinois Police Department and the Federal Bureau of Investigation and is ongoing. The case is being prosecuted by Assistant United States Attorney Michael C. Carr.
